Terms of Service

These Terms of Service ("Terms") govern your access to and use of Brompter ("the Service"), a digital product operated by Brompter ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. Effective date: February 20, 2026.

1. Operator

Brompter is operated by an individual based in Poland. Contact: hello@brompter.pro.

2. Service Description

Brompter is a web-based AI prompt builder that enables users to compose cinema-quality image generation prompts using cinematic parameters such as camera angles, film stocks, lighting, and artistic styles.

3. Account & Eligibility

You must be at least 16 years old to use the Service. You are responsible for maintaining the security of your account credentials and for all activities under your account. By creating a free account, you enter into a contract for the free-tier services. You may delete your account at any time from your settings.

4. Purchase & Payment

Brompter offers a one-time purchase ("Creator Edition") granting access to all premium features for as long as the Service is commercially available and actively maintained ("Lifetime Access"). This does not mean perpetual or infinite access. Payment is processed securely via Stripe. The price is displayed at checkout and may vary by currency.

5. Digital Content & Right of Withdrawal

Brompter is a digital product with immediate delivery. In accordance with EU Directive 2011/83/EU (Article 16(m)) and the Polish Consumer Rights Act (Art. 38 pkt 13), by completing your purchase you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once access to the digital content is granted. This consent is obtained via a mandatory checkbox before checkout.

6. No Refund Policy

Due to the digital nature of the product and immediate delivery of access, all sales are final. No refunds will be issued after purchase, except where required by mandatory applicable law or in case of a demonstrable technical defect preventing access to purchased features. For US customers: this product is a digital good; no cooling-off period applies under federal law. For EU/EEA customers: your right of withdrawal is waived as described in Section 5. This does not affect your statutory rights regarding defective digital content under EU consumer protection law.

7. Acceptable Use

You agree not to: (a) use the Service to generate prompts for illegal, harmful, or abusive content; (b) attempt to reverse-engineer, scrape, or automate access to the Service; (c) share your account credentials with others; (d) circumvent usage limits or technical restrictions; (e) upload content that infringes third-party intellectual property rights; (f) use the Service to harass, bully, or threaten others. We reserve the right to remove content and suspend accounts that violate these rules.

8. Intellectual Property

All content, design, code, and branding of Brompter are our intellectual property. Prompts you create using the Service are yours. You may not reverse-engineer, copy, or redistribute any part of the Service.

9. User Content & Community

You retain ownership of content you submit (presets, images, prompts). By sharing content in the Community Gallery, you grant us a worldwide, non-exclusive, royalty-free license to display, reproduce, and create derivative works (such as thumbnails and previews) of your content within the Service. This license terminates when you delete the content or your account, except for copies that may exist in backups for up to 30 days. We may moderate or remove content that violates the Acceptable Use rules above.

10. AI-Generated Content

Brompter is a prompt-building tool. We do not generate images. You are solely responsible for how you use prompts created with the Service and any images generated from them using third-party AI models. We make no warranties regarding the output quality, accuracy, or legality of AI-generated content. You are responsible for ensuring your generated content does not infringe third-party rights.

11. Account Suspension & Termination

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, upload illegal content, or misuse the Service. You may delete your account at any time from your account settings. Upon termination for cause, your license to access premium features is revoked. We will provide reasonable notice except in cases of severe violation.

12. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. We are not liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability is limited to the amount you paid for the Service. These limitations do not apply to liability that cannot be excluded under mandatory applicable law, including consumer protection rights in the EU/EEA.

13. Service Discontinuation

In the event we discontinue the Service, we will provide at least 90 days' prior notice via email. During this period, you will be able to export your data. We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, internet outages, third-party service failures, or government actions (force majeure).

14. Changes to Terms

We may update these Terms from time to time. For material changes, we will notify you at least 30 days in advance via email. If you do not agree with the changes, you may delete your account before they take effect. Continued use after the effective date constitutes acceptance.

15. Governing Law & Disputes

These Terms are governed by the laws of Poland. Any disputes shall be resolved by the competent courts in Poland. For EU consumers: this does not affect your mandatory consumer protection rights under your local law, and you may bring proceedings in the courts of your country of residence. Online Dispute Resolution: The European Commission provides an ODR platform at https://ec.europa.eu/consumers/odr. These Terms are available in English and Polish. In case of discrepancy, the English version prevails.

16. Severability & Contact

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect. For questions about these Terms, contact us at hello@brompter.pro.
